These Terms and Conditions ("Terms") govern your access to and use of the Website, including any content, functionality, and services offered on or through the Website, as well as your purchase of any products or services ("Products and Services") from us, your visits to the farm, and your consumption or use of our Products and Services. By accessing or using the Website, visiting the farm, placing an order for Products and Services, or consuming or using our Products and Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website, visit the farm, or purchase, consume, or use our Products and Services. These Terms apply to all visitors, purchasers, and consumers.

1. Acceptance of Terms

By using the Website, visiting the farm, or purchasing, consuming, or using Products and Services, you represent that you are at least 18 years old and capable of entering into a legally binding agreement. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Website or engagement with us after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

2. Website Use and Conduct

You may use the Website for lawful purposes only. You agree not to:

  • Use the Website in any way that violates any applicable federal, state, or local law or regulation.

  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website.

  • Transmit any viruses, malware, or other harmful code.

  • Attempt to gain unauthorized access to any part of the Website or our systems.

  • Use the Website, Products, or Services for commercial profit or gain without our express written permission.

  • Use the Website to harm us, our business, our reputation, or any third party.

We reserve the right to terminate your access to the Website, deny entry to the farm, refuse to sell or provide any Products or Services, or otherwise decline to do business with you, at any time and for any reason, including but not limited to violation of these Terms, safety concerns, or any other reason we deem appropriate in our sole discretion.

3. Product and Service Descriptions and Availability

We strive to provide accurate descriptions of our Products and Services on the Website. However, we do not warrant that descriptions, images, or other content on the Website are error-free, complete, or current. Products and Services may vary slightly from their depictions due to natural variations in farming or custom work.

All Products and Services are subject to availability, including seasonal or sold-out items. We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion, even after confirmation. If a Product or Service is unavailable, we will notify you.

All Products and Services must be picked up in person at the farm located in Mount Holly, Vermont. We do not offer shipping or delivery services. Our Products may not be resold under any circumstances without our prior written permission.

4. Orders, Pricing, and Payment

To place an order, you may contact us via the Website or phone. All prices are in U.S. dollars and do not include applicable taxes, which will be added at the time of purchase unless otherwise stated.

We accept cash payments only, payable at the time of pickup at the farm. By placing an order, you agree to pay the total amount due in cash upon pickup. We reserve the right to correct any pricing errors and to refuse or cancel orders placed at an incorrect price.

Title and risk of loss for Products and Services pass to you upon pickup at the farm or completion of services.

5. Pickup and Farm Visit Policy

All Products must be picked up at the farm in Mount Holly, Vermont during designated or scheduled pickup hours. Many of our Products (such as raw milk, fresh eggs, vegetables, and other perishable or time-sensitive items) are highly perishable or subject to limited production windows, so pickup must occur at the specific date and time frame we provide when confirming your order. You will be given a scheduled pickup window, and it is your responsibility to arrive within that window. Failure to pick up your order within the scheduled time frame will result in forfeiture of the order, and you will still be charged the full purchase price. We may also assess additional fees for no-shows, late pickups, cleaning, storage, disposal of spoiled goods, or repeated scheduling issues, as determined by us. We are not responsible for spoilage, quality degradation, or any other issues arising from delayed or missed pickups.

You are responsible for ensuring proper storage and transportation of perishable Products immediately after pickup to prevent spoilage. We are not responsible for any issues arising after pickup. For Services, you are responsible for providing safe access to the site and complying with any instructions provided.

Visits to the farm are at your own risk and subject to the following rules:

  • By entering the farm, you acknowledge and accept that this is an active, working farm with inherent and unavoidable hazards, including (but not limited to) uneven and slippery terrain, mud, ice, heavy machinery in operation, livestock and other animals, tools and equipment, and natural conditions. These hazards may cause slips, trips, falls, animal-related injuries, equipment-related injuries, or other serious harm. You voluntarily assume all such risks, agree that you enter entirely at your own risk, and are solely responsible for any resulting injuries, losses, or damages. We shall not be liable for any such incidents.

  • All visitors must be accompanied by a member of our team at all times; no self-guided tours are permitted.

  • No pets, dogs, or other animals are permitted on the farm premises under any circumstances. This protects our working livestock from stress/injury, prevents disease spread, avoids accidents/damage from uncontrolled animals, and reduces safety/liability risks. Emotional support or therapy animals do not qualify as service animals under the ADA and are prohibited. Legitimate service animals (ADA-defined: trained dogs/miniature horses for disability tasks) will be permitted only where required by law and may be restricted from animal contact, production, or high-risk areas to avoid fundamental alteration of operations, direct threats, or contamination.

  • This is our private family home and working farm. By entering, you are granted limited permission to access only the designated areas (such as pickup zones, parking, or guided visit paths) for the specific purpose of your visit or pickup. You must stay within those permitted areas at all times, follow all directions from farm team members, and respect our privacy and property. Unauthorized entry into restricted, residential, operational, or marked "off-limits" areas is strictly prohibited and constitutes trespassing. Violators may be asked to leave immediately and could face further action under Vermont law. We live and work here—please treat the property and our family space with the same respect you would expect for your own home.

  • All children must be supervised by an adult at all times. Parents/guardians are fully responsible for their children's behavior, safety, and compliance with these rules. Do not allow children to run, chase animals, or enter restricted areas.

  • Do not feed, touch, or interact with animals without explicit permission from farm staff. Unauthorized interactions can stress animals or pose safety risks.

  • No outside food, drinks, smoking, vaping, alcohol, or open flames are permitted unless explicitly authorized.

  • Report any accidents, injuries, unsafe conditions, or concerns immediately to farm staff.

  • Wear closed-toe, sturdy shoes and appropriate clothing (e.g., long pants recommended in animal or field areas); sandals, flip-flops, or inadequate attire are not permitted for safety reasons.

WARNING: Under Vermont law, an agritourism host is not liable for the injury or death of a participant in an agritourism activity resulting from the inherent risk of the agritourism activity. Inherent risks include the risk of animals, weather, land conditions, and the potential for you as a participant to act in a negligent way that may contribute to your own injury or death. You are assuming the risk of participating in this agritourism activity.

By entering the farm or participating in any activity, you acknowledge this warning and assume the inherent risks of agritourism.

We reserve the right to deny entry, remove any visitor, or refuse service for non-compliance with these rules or for any other reason in our sole discretion.

6. Returns, Refunds, and Exchanges

All sales are final. Due to the perishable nature of our Products and in compliance with Vermont and federal food safety regulations, we do not accept returns, refunds, or exchanges under any circumstances, including for damaged or defective Products and Services.

7. Intellectual Property

All content on the Website, including text, images, logos, and designs, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

8. Disclaimers and Product Warnings

THE WEBSITE, PRODUCTS, AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Our Products and Services carry inherent risks, and use or consumption may lead to serious health or safety issues. All warnings are provided in accordance with Vermont law and federal guidelines from the FDA and USDA. Homemade food items are produced and sold in limited quantities consistent with Vermont cottage food exemptions.

  • Raw Milk Warnings: Pursuant to Vermont law (6 V.S.A. § 2777): ““Unpasteurized (Raw) Milk. Keep Refrigerated.” “Consuming raw unpasteurized milk may cause illness, particularly in children, seniors, persons with weakened immune systems, and pregnant women.””. Raw, unpasteurized milk can contain harmful bacteria such as Salmonella, E. coli, Listeria, Campylobacter, and others. These can cause foodborne illnesses, including severe symptoms like diarrhea, vomiting, abdominal pain, and in rare cases, hospitalization or death. Risks are higher for pregnant women, children, older adults, and those with weakened immune systems. We do not recommend raw milk for these vulnerable groups. Pasteurization kills these bacteria, but our raw milk is not pasteurized.

  • Egg Warnings: Fresh free-range eggs may contain harmful bacteria such as Salmonella if consumed raw or undercooked. This can cause foodborne illnesses with symptoms like diarrhea, fever, and abdominal cramps. Risks are higher for vulnerable groups. Cook eggs thoroughly to an internal temperature of 160°F.

  • Undercooked or Raw Meat Warnings: Consuming raw or undercooked meats may increase your risk of foodborne illness, especially if you have certain medical conditions. Pathogens like Salmonella, E. coli, Campylobacter, and Listeria can be present, leading to symptoms such as nausea, vomiting, fever, and more severe complications. Use a food thermometer to ensure meats are cooked to safe internal temperatures as recommended by the USDA: ground meats to 160°F, poultry to 165°F, and whole cuts to 145°F (with a 3-minute rest).

  • Meat Not Processed in USDA Facility: Some of our meats may be custom-processed in facilities exempt from continuous USDA inspection under federal exemptions for intrastate sales. These Products are not subject to federal inspection and may carry higher risks of contamination or defects. They are labeled accordingly and are intended for personal consumption only, not for resale. Consumption assumes you understand these Products do not meet commercial USDA standards and comply with Vermont's exemptions for farm-direct sales.

  • Garden Vegetables Warnings: Fresh vegetables may carry risks of contamination from soil, water, wildlife, or handling, including bacteria like E. coli or parasites. Wash thoroughly before consumption. Risks are higher if eaten raw.

  • Homemade Baked Goods Warnings: These non-potentially hazardous baked goods are produced under Vermont cottage food exemptions in limited quantities. They may contain allergens such as nuts, dairy, eggs, wheat, or gluten, which can cause allergic reactions ranging from mild discomfort to anaphylaxis. They may also spoil if not stored properly, leading to foodborne illness. Consume promptly and store as directed.

  • Homemade Canned Goods Warnings: These are limited to approved high-acid or acidified items sold in limited quantities under Vermont cottage food exemptions. They may carry risks of botulism or other foodborne illnesses if not properly handled, stored, or consumed. Botulism toxin is invisible, odorless, and tasteless but can cause severe symptoms including paralysis and death. Always inspect jars for signs of spoilage (e.g., bulging lids, leaks, off odors, or unusual appearance) and discard if compromised. Follow USDA guidelines for safe storage, handling, and consumption of home-canned foods, including boiling low-acid items (if applicable) before serving where recommended.

  • Homemade Beauty Products Warnings: These are not FDA-evaluated or approved cosmetics and are sold in limited quantities for personal use. They may cause skin irritation, allergic reactions, infections, or other adverse effects. Perform a patch test before use and discontinue if irritation occurs. Not intended to diagnose, treat, cure, or prevent any disease or condition.

  • Homemade Herbal Remedies Warnings: These are not FDA-evaluated or approved and are sold in limited quantities for personal use. They may interact with medications, cause side effects, be ineffective, or pose risks of allergic reactions, toxicity, or contamination. Consult a healthcare professional before use, especially if pregnant, nursing, or have medical conditions. Not intended to diagnose, treat, cure, or prevent any disease or condition.

  • Maple Syrup Warnings: Maple syrup may develop mold if not refrigerated after opening or if stored improperly. It may also cause allergic reactions in rare cases. Consume within recommended time frames and store in a cool, dark place.

  • Hay Warnings: Hay may contain dust, mold, or allergens that can cause respiratory issues, allergies, or irritation. Handle with care, especially if you have pre-existing conditions.

  • Lumber and Custom Sheds Warnings: Rough cut lumber and custom sheds involve risks such as splinters, heavy lifting injuries, or structural issues if not handled or installed properly. Use appropriate safety equipment and follow best practices for woodworking and construction.

  • Custom Hire Services Warnings: Services involve heavy machinery and outdoor work, which carry risks of injury, property damage, or environmental impact. You are responsible for site preparation and any permits required.

Always handle Products and Services safely: refrigerate perishables promptly, cook thoroughly where applicable, use protective gear for non-food items, and follow safety guidelines from the FDA, USDA, and OSHA.

9. Assumption of Risk

By visiting the farm, purchasing, using, or consuming any of our Products and Services, whether currently available, sold out, or described on the Website, you acknowledge and voluntarily assume all risks associated with them, including but not limited to foodborne illnesses, allergic reactions, physical injuries, property damage, or other health or safety issues arising from their use, consumption, or from farm visits (such as slips, trips, or falls due to mud, ice, or other hazards). You agree that we have provided adequate warnings in compliance with Vermont and federal laws, and you proceed entirely at your own risk, waiving any claims against us to the fullest extent permitted by law.

10. Indemnification and Hold Harmless

To the fullest extent permitted by law, you agree to promptly indemnify, defend, and hold harmless 14th Star Farms, its owners, employees, agents, affiliates, successors, assigns, heirs, executors, administrators, and representatives (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, damages, losses, liabilities, costs, expenses, penalties, fines, settlements, judgments, and reasonable attorneys' fees and court costs (collectively, "Claims") arising out of or related in any way to your (or any person under your supervision or control, including minors) visit to the farm, purchase, consumption, use, or misuse of our Products and Services, or participation in any agritourism activity, including any third-party Claims for injury, illness, bodily harm, death, property damage, emotional distress, or any other harm (whether known or unknown, foreseen or unforeseen).

This indemnification includes, but is not limited to, Claims related to the risks outlined in Sections 5, 8, and 9, or any inherent risks of agritourism as defined under Vermont law (including Act 31 of 2021), even if caused in whole or in part by the negligence (but not gross negligence or willful misconduct) of any Indemnified Party.

You hereby release, waive, discharge, and covenant not to sue, make any claim against, or seek any recovery from the Indemnified Parties for any and all liability, Claims, or causes of action arising from the foregoing, on behalf of yourself, your heirs, executors, administrators, successors, assigns, and any minors or others under your care or supervision. This release and indemnification shall be binding on your heirs, executors, administrators, successors, and assigns, and shall survive any termination of these Terms or your relationship with us.

This provision is intended to be as broad and inclusive as permitted by Vermont law and shall be interpreted accordingly.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS, THE WEBSITE, FARM VISITS, OR THE PRODUCTS AND SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Vermont, without regard to conflict of laws principles, and in accordance with applicable federal laws. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Rutland County, Vermont. You consent to the personal jurisdiction of such courts.

13. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full effect. These Terms constitute the entire agreement between you and us regarding the Website, farm visits, and Products and Services, superseding any prior agreements.
